Local Law 77 & Local Law 159: What NYC Building Owners Need to Know

Why NYC regulates cooling towers
Local Law 77 and Local Law 159. Both exist for one reason: cooling towers can harbor and spread Legionella bacteria, the causative agent of Legionnaires’ disease.
New York City enacted Local Law 77 in 2015 after a Legionnaires’ disease outbreak in the South Bronx, linked to a contaminated cooling tower, sickened over 120 people and caused at least 12 deaths. The law created the nation’s most comprehensive cooling tower oversight program, requiring registration, regular water testing, and documented maintenance plans for every covered building.
Over ten years later, Local Law 159 has tightened those requirements significantly, shortening testing intervals to 31 days, raising penalties, and closing gaps identified through a decade of enforcement data.

Local Law 77: the foundation
Local Law 77 applies to every cooling tower, evaporative condenser, and fluid cooler in New York City. It set the original framework that Local Law 159 now builds on.
Core requirements

- Registration — Every covered device must be registered with the NYC Department of Health and Mental Hygiene (DOHMH) through the Cooling Tower Registration Portal, in addition to New York State registration.
- Written maintenance plan — A qualified professional (licensed engineer, certified industrial hygienist, certified water technologist, or environmental consultant) must develop a Maintenance Program and Plan conforming to ASHRAE Standard 188.
- Routine testing — Legionella culture testing during the operating season, with results reviewed against defined action thresholds.
- Tiered response — Legionella results of 10 CFU/mL or higher require documented corrective action; results of 1,000 CFU/mL or higher must be reported to DOHMH within 24 hours.
- Annual certification — Owners must certify compliance to DOHMH by November 1 each year.
- Recordkeeping — Maintenance, testing, and inspection records must be retained for at least three years and made available on request.
Local Law 159: what changed
Local Law 159 amends Local Law 77 with stricter testing cadence, tighter lab standards, and significantly higher penalties. Its core provisions became enforceable on May 7, 2026 — building owners citywide are now operating under these rules.
Testing & lab standards
- Legionella sampling is now required at least every 31 days while a tower is operating — replacing the previous requirement of every 90 days.
- Samples must be analyzed by a DOHMH-approved, ELITE-certified laboratory.
- Enhanced disinfection protocols are mandatory every year between July 1 and August 31, the peak-risk period for bacterial growth.
Penalties & documentation
- Fines for registration, certification, and inspection violations have doubled from the original Local Law 77 amounts.
- Civil penalties can begin at $10,000 per violation; failure to disinfect a contaminated tower can carry fines up to $25,000 per tower and potential misdemeanor liability.
- Maintenance Program documentation must be updated to reflect the new testing cadence and retained alongside all lab reports and service logs.
